§8-33-1 Financing adult education program. The financial support for the adult education program shall be in part from fees collected from students enrolled, and in part from public funds appropriated for this purpose in accordance with state and federal laws. Administrative and supervisory costs, costs of instruction and all other necessary expenses not covered by fees and other authorized charges shall be paid from funds appropriated for this purpose. §8-33-2 Instructional fees. Students enrolling in adult education classes may be assessed instructional fees. The superintendent of education shall set the amount of the instructional fees, in accordance with the recommendations of the advisory council, based upon the cost per instructional hour for each adult education class. No instructional fee shall be assessed for adult basic education (ABE) classes and senior citizens' program classes. §8-33-3 Equipment fees. Students enrolling in adult education homemaking, art, industrial arts, and business education classes may be assessed equipment fees. The superintendent of education shall set the equipment fee in accordance with the recommendations of the advisory council. An equipment fee shall be based upon the cost of maintenance and repair of equipment used in a class. §8-33-4 Supply and material fees. Students in adult education classes may be assessed supply and material fees to defray the cost of instructor-provided expendable supplies and materials, such as food items or clothing material, used in the classroom and which are necessary for conducting the class. Supply and material fees shall be determined by the instructor by pro rating the actual cost of instructor-provided supplies and materials among students enrolled in the class. §8-33-5 General educational development testing fees. Each adult education student taking a general educational development (GED) test shall be assessed a fee. The superintendent of education, with the recommendation of the advisory council, shall set the fee amount, provided that the general educational development testing fee shall be based upon the cost of test materials and proctor services. §8-33-6 Waiver of fees. All fees that may be assessed for adult education by the department of education may be waived by the principal for the following categories of students:

(1) Adults registered with the department of labor and industrial relations who are unemployed when they enroll in courses which will assist them in securing employment;

(2) Adults certified by the department of human services as indigent when they enroll in classes which will assist them to become self-sustaining; and

(3) Veterans who are entitled to federal educational assistance upon authorization of the veterans administration. Fees shall be charged against federal funds in accordance with veterans administration contract regulations. §8-33-7 Refunds for withdrawal from adult education classes. A student who withdraws from an adult education class shall be refunded fees paid for the classes as follows:

(1) Instructional and equipment fees shall be refunded in full if the student withdraws prior to the second meeting of the class. Refunds of instructional and equipment fees shall not be made to the student who withdraws after the second meeting of the class has convened;

(2) Supply and material fees shall be refunded in full if student withdraws prior to the second meeting of the class. One-half of the supply and material fees shall be refunded if the student withdraws at any time from the second meeting until one-half of the total scheduled class meetings have been held. Refunds of supply and material fees shall not be made to the student who withdraws after one-half of the total scheduled class meetings have been held.
